An Ordinance Accepting Sewer Easement and Declaring an Emergency

ORDINANCE 2010-19, VILLAGE OF YELLOW SPRINGS, OHIO
ACCEPTING A SEWER EASEMENT FROM MORRIS BEAN COMPANY AND DECLARING AN EMERGENCY
Interested persons will take note that the Village Council of Yellow Springs on Monday, October 18, 2010, gave first reading to and passed an emergency ordinance, text to follow.
Whereas, the Village of Yellow Springs has entered into a Sanitary Sewer Connection Agreement with the Morris Bean Company (MB); and
Whereas, as part of that Agreement MB must provide a sanitary sewer easement over a portion of its lands;
NOW, THEREFORE, THE COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
Section 1. The Village hereby accepts a sanitary sewer easement from MB in a form substantially like the form currently on file with the Clerk of Council.
Section 2. The Village Manager is authorized to execute the easement.
Section 3. This ordinance is hereby declared to be an emergency measure immediately necessary to preserve the public peace, health, safety and welfare, and more specifically to allow the easement to go into effect immediately to allow construction of the sewer line to eliminate an unwanted sewer package plant. Wherefore, this ordinance shall become effective immediately upon its adoption.
