Emergency Ordinance Regarding the Energy Board

ORDINANCE NO. 2011-33, VILLAGE OF YELLOW SPRINGS, OHIO
Interested persons will take note that the Village Council of Yellow Springs on Monday, December 19, 2011, gave first reading to an ordinance, text to follow.
Council will consider said ordinance for second reading and possible passage into law during a public hearing to begin at 7:10 p.m. Tuesday, January 3, 2012, in the Bryan Community Center, 100 Dayton Street.

WHEREAS, the Council for the Village of Yellow Springs adopted Ordinance 2010-11 on July 19, 2010 which established an Energy Board (EB); and
WHEREAS, the EB has experienced difficulty achieving a quorum of members for its meetings and Village Council believes a reduction in the number of members on the EB will help this important committee achieve quorums for their meetings and allow them to continue to work on important Village sustainability issues; and
WHEREAS, Village Council wishes to amend Section 286.03 to reduce the number of members on the Energy Board.

NOW, THEREFORE, THE COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
SECTION 1. Existing Section 286.03 Membership of Chapter 286 Energy Board of the Codified Ordinances is hereby repealed in its entirety.
SECTION 2. A new Section 286.03 is hereby enacted to read as follows:
286.03 MEMBERSHIP.
The Energy Board will consist of five members, to be appointed by Council. One member shall be a member of Council, appointed to serve at the pleasure of Council. The other members shall be appointed for three-year terms. Initial appointments shall be staggered to allow regular rotation of members. The Board shall select its own Chairperson annually. As an official board of Council, all meetings of the Energy Board must be advertised and open to the public. To be considered official, meetings must be kept by a quorum, determined to be a simple majority of the members. Official meeting minutes must be kept, approved and forwarded to the Council Clerk
for distribution and records retention. The Board may establish its own rules of procedure or otherwise shall follow Robert’s Rules of Order.
SECTION 3. This ordinance is hereby declared to be an emergency measure immediately necessary to preserve the public interest and for the health, safety and welfare of the citizens of the Village, and more specifically to allow for the orderly meeting of this important public body to conduct the public’s business without further delay, wherefore, this ordinance shall be in effect upon its adoption by Council.
