ORDINANCE NO. 2014-16, VILLAGE OF YELLOW SPRINGS, OHIO

Determining to Proceed with the Center for Business and Education and Authorizing Village Manager to Retain Bond Counsel

WHEREAS,
the Village Council has determined that there is good cause for proceeding with the development known as the Center for Business and Education (“CBE Public Improvement Project”); and

WHEREAS,
the CBE Public Improvement Project requires the use of public funds for the construction and extension of public roads and streets, including the necessary storm water, sanitary sewer and water facilities, traffic signals and other necessary appurtenances and to solicit bids for this project; and

WHEREAS, in order to proceed with the CBE Public Improvement Project, the Village will need to issue bonds and solicit bids from contractors; and

WHEREAS, this ordinance is being passed pursuant to Section 70 of the Charter of Yellow Springs that creates the right of referendum for measures pertaining to ordinances determining to proceed on public improvements.

NOW, THEREFORE, THE COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO, GREENE COUNTY, HEREBY ORDAINS THAT:

Section 1. The Council of the Village of Yellow Springs hereby determines that the Village intends to proceed with the CBE Public Improvement Project.

Section 2. The Village Manager is hereby authorized to retain bond counsel and solicit bids for the construction of improvements related to the CBE Public Improvement Project.

Section 3.
This Council finds and determines that all formal actions of this Council and any of its committees concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in those formal actions were in meetings open to the public, all in compliance with the law.

Section 4.
This Ordinance shall go into effect at the earliest period allowed by law.
