AN ORDINANCE DECLARING SURPLUS PROPERTY AND SALE

ORDINANCE NO. 2012-02, VILLAGE OF YELLOW SPRINGS, OHIO

Interested persons will take note that the Village Council of Yellow Springs on Tuesday, January 17, 2012, gave first reading to an ordinance, text to follow.

Council will consider said ordinance for second reading and possible passage into law during a public hearing to begin at 7:10 p.m. Monday, February 6, 2012, in the Bryan Community Center, 100 Dayton Street.

WHEREAS, the Village of Yellow Springs, Ohio owns certain real estate that is not required for the operations of the Village, nor it is foreseeable that it will be used for Village purposes in the future; and

WHEREAS, some of that surplus property is located adjoining the business establishment known as Millworks Development, Inc; and

WHEREAS, the owners of Millworks Development, Inc wish to acquire a small piece of that property to allow for expansion of the business; and

WHEREAS, the Village wishes to encourage the expansion of businesses in Yellow Springs;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF YELLOW SPRINGS, OHIO THAT:
Section 1. The property (“Property”) identified on Exhibit A is hereby
declared to be surplus property unneeded for the immediate or future needs of the Village government.

Section 2. The Village of Yellow Springs has been contacted by an adjacent business owner who wishes to acquire the surplus Property to assist in expansion of an existing business in downtown Yellow Springs. The business owner has performed a survey and appraisal of the Property from professionals acceptable to the Village of Yellow Springs. The appraised value was found to be $1,700.00.

Section 3. The Village of Yellow Springs, pursuant to the home rule powers vested in it by the Ohio Constitution and the Charter of the Village of Yellow Springs, hereby waives the competitive bidding requirement and hereby declares it to be in the public interest to transfer the property described on Exhibit A to Millworks Development Corporation, an Ohio limited liability company for One Dollar ($1.00) and other good and valuable consideration.

Section 4. This Ordinance shall go into effect at the earliest period allowed by law.
