Accepting a Utility Easement Across the Property of Family Choices Real Estate LLC

ORDINANCE NO. 2014-14, VILLAGE OF YELLOW SPRINGS, OHIO
Interested persons will take note that the Village Council of Yellow Springs on Monday, June 2, 2014, gave first reading to an ordinance, text to follow.
Council will consider said ordinance for a second reading and a public hearing to begin at 7:10 p.m., Monday, June 16, 2014, in the Bryan Community Center, 100 Dayton St.
WHEREAS, the construction of a new hotel at the northeast intersection of Xenia Avenue and Limestone Street requires water service to the site, and
WHEREAS, the nearest location capable of providing service adequate to the demands likely to be imposed by the new hotel is the water line directly west of the hotel on South Walnut Street, and
WHEREAS, the most direct and efficient path to connect the water line with the hotel requires crossing the land of Family Choices Real Estate LLC, and
WHEREAS, Family Choices Real Estate LLC has kindly agreed to grant the necessary easement to the Village,
NOW, THEREFORE, THE COUNCIL OF THE VILLAGE OF YELL0W SPRINGS, OHIO DOES HEREBY ORDAIN THAT:
Section 1. The Village hereby accepts the utility easement proffered by Family Choices Real Estate, LLC.
Section 2. A copy of the easement is attached hereto and incorporated in this ordinance by reference.
Section 3. The Village relays its thanks and appreciation to Family Choices Real Estate, LLC for their cooperation and assistance in a project likely to be of mutual benefit to them and the Village.
Section 4. This ordinance shall take effect and be in force 30 days following its adoption.
