An Ordinance Amending Section 1048.05 – Regarding Seasonal Rates for Sewer Services for Residents Whose Water Use During Summer Months is Greater Than Usual Due to Gardening or Lawn Watering.

ORDINANCE NO. 2014-13, VILLAGE OF YELLOW SPRINGS, OHIO

Interested persons will take note that the Village Council of Yellow Springs on Monday, June 2, 2014, gave first reading to an ordinance, text to follow.

Council will consider said ordinance for a second reading and a public hearing to begin at 7:10 p.m., Monday, June 16, 2014, in the Bryan Community Center, 100 Dayton St.

WHEREAS, some residents of the Village consume greater amounts of water than usual during summer months due to their use of water for gardening or watering lawns, and,

WHEREAS, since user charges for sewer service are based on metered water use, and water applied to lawns and gardens does not enter the sewer system, this system for calculating sewer charges is inequitable,

NOW, THEREFORE, THE COUNCIL OF THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:

Section 1. To reduce the inequity cited above, residential customers who will engage in landscape or garden watering may, at their option, apply annually to participate in an alternative means of calculating their Village utility bills.

Section 2.
A new subsection 1048.05 (g) shall be added to read as follows: For those residents who apply and are accepted, the Village utility billing office will use that customer’s water use in the preceding December, January and February as a base line, then compare it to their use for the following June, July and August. Any summer use that reflects higher consumption in summer months will be deducted from that customer’s sewer charges. The adjustment will be made in September, October, or November, depending upon which month’s bill is based on that customer’s actual meter reading.

Section 3.
The policies for instituting and administering this program (e.g., deadline to apply for participation) shall be promulgated by the Village Finance Director.

Section 4. This ordinance shall take effect and be in force from and after the earliest date permitted by law.
