REGARDING COMPLAINTS OF TALL GRASS OR WEEDS ON PRIVATE PROPERTY
ORDINANCE 672.02 – REMOVAL OF PLANTS AND WEEDS BY OWNER
The Village of Yellow Springs, Ohio, is hereby requesting that landowners remove or mow tall grass or weeds that are in violation of Section 674.02 of the Codified Ordinances of the Village. Several complaints have been received by the police and Village Manager’s office for grass or weeds taller than twelve inches on the property, including rights-of-way.
Section 674.02 of the Codified Ordinances states:
The landowner shall cut or mow or cause to be cut or mowed the following:
• Common ragweed (ambrosia artemisiifolia)
• Giant ragweed (ambrosia trifida)
• Canada thistle (cirsium arvense)
• Poison Ivy (Rhus radicans)
As well as any other uncultivated non-woody plant growth growing within five feet of the interior side or rear lot line, or within ten feet of the street side or front lot line, to prevent the same from blooming or going to seed or exceeding a height of twelve inches, provided, however, that abutting property owners may agree to waive this requirement along their mutual property lines.
No dumping, substandard structure or stagnant water will be permitted in conjunction with unmowed plant growth. Suitably managed compost piles are not restricted by this provision.
Tall grass or weeds [non-woody] should be removed to a height of less than 12 inches in compliance with and in a manner authorized with Section 674.02.
ll grass and weeds not cut, mowed or otherwise or removed by July 1 could be remediated by the Village public works staff or Village contractor(s). The landowner will receive notice by regular mail, postmarked at least five (5) days prior to the staff or a contractor is authorized to enter upon the property to cut or remove the tall grass and weeds. The notice will be sent by regular mail to the landowner’s last known address or best obtainable address (Cod. Ord. Section 674.03). Because of the cost to the Village for mowing, these costs will be assessed to the landowner pursuant to Section 674.04. Such remedy is in addition to the penalties provided in Sections 674.01(b) and 674.02(c).
