REPEALING AND REPLACING SECTION 1064.02—RATES, ADMISSIONS AND
SEASON HOURS OF CHAPTER 1064—MUNICIPAL SWIMMING POOL OF PART TEN
—STREETS, UTILITIES AND PUBLIC SERVICES OF THE CODIFIED ORDINANCES OF THE
VILLAGE OF YELLOW SPRINGS, OHIO, AND DECLARING AN EMERGENCY ORDINANCE 2020-06, VILLAGE OF YELLOW SPRINGS, OHIO

Interested persons will take note that the Village Council of Yellow Springs on Monday, May 18, gave reading and passed as an emergency, ordinance 2020-06, text to follow.

WHEREAS, Gaunt Park Pool will open under emergency directives related to the COVID-19 pandemic, and requires new operational procedures as directed by Governor DeWine and the Ohio Department of Health and recommended by the Centers for Disease Control (CDC); and
WHEREAS, despite a strong desire to make the only public pool remaining in Greene County as accessible as possible, the current season pass model is not feasible under the recommended operational procedures;
NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
Section 1. Existing code section 1064.02 Rates, Admission and Season Hours is hereby repealed in its entirety.
Section 2. A new section 1064.02, Rates, Admission and Season Hours is hereby enacted to read as follows.
Daily Admission
3 years & younger with paying adult. .  .  .  .  .  .  .  .  .  . Free
Ages 4–18 and seniors 62 & older . .  .  .  .  .  .  .  .  .  . $3
Ages 19–61 . .  .  .  .  .  .  .  .  .  .  .  .  .  .  .  .  . $5
Each admission is for a two-hour session.
Section 3. There shall be no organized swim meets or private pool rentals.
Section 4. The Village Manager is authorized to implement the new rates at the earliest date applicable by law.
Section 5. The Village Manager is authorized to implement the “Swimming for All” program pursuant to Ordinance 2011-17, to provide access to the pool for low income Village residents as resources allow which would permit the purchasers of two-hour pool passes to purchase these at half-price.
Section 6. The Village Manager is further authorized to implement and modify pool rules and policies as needed based upon guidance and recommendations of the Governor and the Ohio Director of Health.
Section 7. Pool use is limited to residents of the Village on Fridays, Saturdays and Sundays, and a guest policy for these days will be developed.
Section 8. Village Resident is one who resides in the Village. Acceptable proof of such is a recent utility bill or a valid ID with address.
Section 9. This Ordinance is hereby declared to be an emergency measure authorized under the Village’s home rule powers necessary for the benefit of the health, safety and welfare of the Village and shall take effect immediately upon approval by Village Council.
