AUTHORIZING A REQUEST TO THE OHIO BOARD OF BUILDING STANDARDS TO CERTIFY
THE VILLAGE OF YELLOW SPRINGS TO EXERCISE RESIDENTIAL ENFORCEMENT AUTHORITY AND PERFORM INSPECTIONS IN ACCORDANCE WITH THE OHIO BASIC BUILDING CODE AND DECLARING AN EMERGENCY
ORDINANCE 2021-13, VILLAGE OF YELLOW SPRINGS, OHIO
Interested persons will take note that the Village Council of Yellow Springs on Monday, June 21, 2021, gave first reading to an ordinance which will receive a second reading and public hearing for possible passage into law Tuesday, July 6, 2021, text to follow.
WHEREAS, the Board of Building Standards of the State of Ohio has formulated and adopted the Ohio Basic Building Code containing regulations governing the erection, construction, repair, alteration, and maintenance of all buildings or classes of buildings specified in Ohio Revised Code Section 3781.06 and Section 3781.10; and
WHEREAS, it is necessary in accordance with law to administer and enforce the Ohio Basic Building code within the limits of the Village of Yellow Springs,
WHEREAS, it is necessary for the Village to request the Ohio Board of Building Standards to certify the Village to enforce the Ohio Basic Building Code independently of Greene County;
NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO, HEREBY ORDAINS THAT:
Section 1. The Village Manager is hereby authorized and directed to submit an application to the Ohio Board of Building Standards requesting said Board to certify the Village pursuant to the requirements of Chapter 3781 of the Ohio Revised Code to enforce the Ohio Basic Building Code within the Village of Yellow Springs.
Section 2. The Village Manager is authorized to negotiate and execute agreement with another qualified certified building official or department to enforce the Ohio Basic Building Code, to accept and approve plans and specifications, and to conduct inspections on behalf of the Village for compliance with the Building Code pursuant to Section 4101 :2-1-03 of the Ohio Administrative Code, except “Plumbing”, Chapters 4101 :2-5 to 4101 :2-69 of the Administrative Code, which shall remain under the jurisdiction of the Greene County Combined Health Department.
Section 3. The terms of the said agreement shall grant full authority to do all things necessary to administer and enforce the Ohio Basic Building Code within the limits of the Village.
Section 4. The Village shall retain all permit and inspection fees authorized by the State of Ohio for such purposes.
Section 5. This Ordinance is an emergency measure, necessary for preservation of public health, safety and welfare and shall take effect immediately upon its passage.
