Ordinance 2022-01 ADOPTING FLOOD DAMAGE RECOMMENDATIONS FROM ODNR

The following ordinance received a first reading on January 4, 2022, and will receive a Public Hearing and vote for passage into law on January 18, 2022.
 
ORDINANCE  2022-01
VILLAGE OF YELLOW SPRINGS, OHIO
 
ADOPTING FLOOD DAMAGE RECOMMENDATIONS FROM THE OHIO DEPARTMENT OF NATURAL RESOURCES BY REPLACING REPEALED CHAPTER 1452 “FLOOD HAZARD AREAS” OF THE VILLAGE CODIFIED ORDINANCES WITH NEW CHAPTER 1452 “FLOOD DAMAGE REDUCTION REGULATIONS.”
 
WHEREAS, the Ohio Department of Natural Resources periodically recommends updates to local floodplain regulations for municipalities based on Federal Emergency Management Agency revision of floodplain maps, and ODNR approval is necessary for the National Flood Insurance Program; and
 
WHEREAS, the Village previously repealed its Building Code provisions for Flood Hazard Areas in Chapter 1452 by Ordinance 2002-08, passed August 5, 2002, and established a Floodplain Overlay District by Ordinance 2013-19 passed September 16, 2013, as part of the Village Zoning Code, Section 1254.02, but has since re-established the Building Department by Ordinance No. 2021-12, passed June 7, 2021,
 
NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS:
 
Section 1. Chapter 1452 of the Village Code is hereby enacted in substantially similar form as the attached and incorporated Exhibit A.
 
Section 2. To the extent that any provision of Section 1254.02 conflicts with the provisions of Chapter 1452, the language of Chapter 1452 supersedes.
 
Section 3. This Ordinance shall become effective at the earliest time provided by law and a copy shall be submitted to the Ohio Department of Natural Resources for review prior to March 8, 2022.
