Ordinance authorizing the donation of unclaimed bicycles
ORDINANCE NO. 2017-2, Village of Yellow Springs, Ohio
Interested persons will take note that the Village Council of Yellow Springs on Tuesday, January 17, 2017, gave first reading to an ordinance, text to follow.
Council will give a second reading and pass into law during a public hearing on Monday, February 6, 2017, in the Bryan Community Center, 100 Dayton St.
Whereas, the Village of Yellow Springs Police Department comes into possession of various bicycles and other personal property in the normal course of its operation; and
Whereas, Section 737.32 of the Ohio Revised Code permits a municipal corporation to adopt legislation to allow the Chief of Police to contribute personal property that is unclaimed for ninety (90) days to public agencies and certain non-profit organizations; and
Whereas, Village Council has determined that it would be in the best interest of the Village to authorize the Chief of Police to contribute unclaimed bicycles to public agencies and certain non-profit organizations in accordance with Section 737.32 of the Ohio Revised Code,
NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
Section 1. Council hereby authorizes the Chief of Police, pursuant to Section 737.32 of the Ohio Revised Code, to contribute bicycles, if not required to be disposed of pursuant to another section of the Revised Code, that remain unclaimed after ninety (90) days to one or more public agencies; to one or more non-profit organizations as described in Section 737.32; or to one or more organizations satisfying Section 501(c)(3) or 501(c)(19) of the Internal Revenue Code of 1986.
Section 2. This ordinance shall take effect and be in full force at the earliest date permitted by law.
