Ordinance 2010-08: Changing rates, admissions and season hours of Gaunt Park Pool

Interested persons will take note that the Village Council of Yellow Springs on Monday, April 19, 2010, gave first reading to and passed an emergency ordinance, text to follow.
AN ORDINANCE REPEALING AND REPLACING SECTION 1064.02-RATES, ADMISSIONS AND SEASON HOURS OF CHAPTER 1064-MUNICIPAL SWIMMING POOL-OR PART TEN-STREETS, UTILITIES AND PUBLIC SERVICES-OF THE CODIFIED ORDINANCES OF THE VILLAGE OF YELLOW SPRINGS, OHIO, AND DECLARING AN EMERGENCY.
NOW, THEREFORE, THE COUNCIL OF THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
Section 1. Existing code section 1064.02 Rates, Admission and Season Hours is hereby repealed in its entirety.
Section 2. A new section 1064.02 Rates, Admission and Season Hours is hereby enacted to read as follows:
The admission rates for the Yellow Springs Municipal Swimming Pool shall be as follows:
(a) Single Admissions:
Persons under the Age of 4 … No Charge (with paying adult)
Persons ages of 4-18 years … $3.50
Persons ages 19-61 years … $5
Persons ages 62 and over … $3.50
(b) Resident Season Passes:
Persons under the Age of 4 … No Charge (with paying adult)
Persons ages of 4-18 years … $65
Persons ages 19-61 years … $95
Persons ages 62 and over … $65
Household (5 or less members) … $125
Each Additional Member … $15
(c) Non-Resident Season Passes:
Persons under the Age of 4 … No Charge (with paying adult)
Persons ages of 4-18 years … $95
Persons ages 19-61 years … $140
Persons ages 62 and over … $95
Household (5 or less members) … $215
Each Additional Member … $20
(d) Pool Rentals (after 8:00 p.m.):
One (1) Hour … $160
Two (2) Hours … $220
Three (3) Hours … $280
Four (4) Hours … $340
(e) Swimming Lessons:
Residents … No Charge
Non-Residents … $10 per session
(f) Pool Hours:
Open Swim: … 1–7 p.m. (All days)
Lap Swim … 11 a.m.–1 p.m. (Monday–Friday)
… Noon–1 p.m. (Saturday & Sunday)
… 7–8 p.m. (All Days)
Section 3. Grandparents shall be permitted to purchase Household Season Passes and list grandchildren who are visiting them during the swimming pool season. All grandchildren shall be considered a separate member of the household and a pass shall not be transferable from one grandchild to another.
Section 4. The Village Manager is authorized to enter into an agreement with the Yellow Springs Sea Dogs Swim Team regarding the use of the pool by said swim team.
Section 5. The Village Manager is authorized to implement the new rates at the beginning of the 2010 swimming pool season.
Section 6. All remaining sections of Chapter 1064 shall be renumbered accordingly.
Section 7. That in order to assure the Village can enact this legislation in order to begin to sell season pool passes a reasonable time before the pool opens in June, this Ordinance is hereby declared to be an emergency measure which shall take effect at the earliest period allowed by law.
