Emergency Ordinance Regarding the Environmental Commission

ORDINANCE NO. 2011-34, VILLAGE OF YELLOW SPRINGS, OHIO
Interested persons will take note that the Village Council of Yellow Springs on Monday, December 19, 2011, gave first reading to an ordinance, text to follow.
Council will consider said ordinance for second reading and possible passage into law during a public hearing to begin at 7:10 p.m. Tuesday, January 3, 2012, in the Bryan Community Center, 100 Dayton Street.
WHEREAS, the Council for the Village of Yellow Springs adopted Ordinance 90- 15 on December 17, 1990 which established an Environmental Commission (EC); and
WHEREAS, the Council for the Village of Yellow Springs adopted Ordinance 2002-11 on December 2, 2002, and Ordinance 2004-07 on February 17, 2004 which amended the original ordinance; and
WHEREAS, the EC has experienced difficulty achieving a quorum of members for its meetings and Village Council believes a reduction in the number of members on the EC will help this important committee achieve quorums for their meetings and allow them to continue to work on important Village environmental issues; and
WHEREAS, Village Council wishes to amend Section 274.02 to reduce the number of members on the Environmental Commission.
NOW, THEREFORE, THE COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:
SECTION 1. Existing Section 274.02 Membership; Chairperson; Quorum of Chapter 274 Environmental Commission of the Codified Ordinances is hereby repealed in its entirety.
SECTION 2. A new Section 274.02 is hereby enacted to read as follows:
274.02 MEMBERSHIP; CHAIRPERSON; QUORUM.
The Environmental Commission will consist of five members, to be appointed by Council. One member shall be a member of Council, appointed to serve at the pleasure of Council. Four members shall be appointed for three-year terms. Of those four members, one member can be a resident of Miami Township outside of the Village limits. The Commission shall select its own Chairperson annually. In the event of the death or resignation of any member, his or her successor shall be appointed by Council to serve for the unexpired period of the term for which such member has been appointed. Three members of the Commission shall constitute a quorum.
SECTION 3: This ordinance is hereby declared to be an emergency measure immediately necessary to preserve the public interest and for the health, safety and welfare of the citizens of the Village, and more specifically to allow for the orderly meeting of this important public body to conduct the public’s business without further delay, wherefore, this ordinance shall be in effect upon its adoption by Council.
