An Emergency Ordinance To Comply With An Order Of Court To Record Deed
Ordinance No. 2013-27, Village Of Yellow Springs, Ohio

Interested persons will take note that the Village Council of Yellow Springs
on Monday, Dec. 2, 2013, gave first reading to an ordinance and passed as an emergency, text to follow.

WHEREAS, the Forest Glen Cemetery Association (the “Association” or “Cemetery”) dissolved the Association and Miami Township (the “Township”)
has undertaken the operation of the Cemetery pursuant to Ohio Revised Code § 517.27; and

WHEREAS, some of the land within the Cemetery is located within the corporate limits of the Village; and

WHEREAS, the Cemetery property is required by Order of the Greene County Court of Common Pleas (attached here as Exhibit A) to be transferred to Miami Township for the reasons that the Township is responsible to take care of, keep in repair, hold treat and manage the Cemetery as required by Ohio Revised Code § 517.01 – 517.32; and

WHEREAS, the Court ordered Miami Township and the Village to record the Deed attached here as Exhibit B on or before December 6, 2013.

Now, Therefore, The Council For The Village of Yellow Springs, Ohio, Greene County, Hereby Ordains That:

Section 1. The Village Manager shall cause the Deed to be recorded to comply with the order of Court.

Section 2. This ordinance is hereby declared to be an emergency measure immediately necessary to preserve the public interest and for the health, safety and welfare of the citizens of the Village, and more specifically to have a chain of title that accurately reflects that Miami Township owns the Cemetery for the purposes of the Township’s present and future operation of the Cemetery and to comply with the Order of Court.
