Approving a temporary construction easement for the purpose of creating an access road to construct the water plant and declaring an emergency

ORDINANCE NO. 2016-16, Village of Yellow Springs, Ohio

Interested persons will take note that the Village Council of Yellow Springs on Monday, Aug. 15, 2016, gave first reading to an ordinance and passed as an emergency, text to follow.

WHEREAS, the construction of a new water plant at the site of the existing water plant on Jacoby Road requires numerous pieces of large construction equipment; and

WHEREAS, at the point at which Jacoby Road meets the property of Ronald and Linda Gillum, Jacoby Road becomes too narrow to accommodate such pieces of large construction equipment; and

WHEREAS, the most direct and efficient path to accommodate this equipment requires a temporary construction easement and road across the property of Ronald and Linda Gillum; and

WHEREAS, Ronald and Linda Gillum have kindly agreed to grant the necessary easement to the Village,

NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELL0W SPRINGS, OHIO DOES HEREBY ORDAIN THAT:

Section 1. The Village hereby accepts the temporary construction easement proffered by Ronald and Linda Gillum from the date the Easement was signed.

Section 2. A copy of the easement is attached hereto and incorporated in this Ordinance as Exhibit A.

Section 3. The Village relays its thanks and appreciation to Ronald and Linda Gillum for their cooperation and assistance in a project likely to be of mutual benefit to them and the Village.

Section 4. This Ordinance is hereby declared to be an emergency measure necessary to expedite a project to preserve the public health and that will benefit the public health and welfare through the provision of viable drinking water. This Ordinance shall take effect immediately upon passage.
