Approving employee regulations pursuant to Charter Section 81 and declaring an emergency

APPROVING EMPLOYEE REGULATIONS PURSUANT TO CHARTER SECTION 81 AND DECLARING AN EMERGENCY
ORDINANCE 2021-37, VILLAGE OF YELLOW SPRINGS, OHIO
WHEREAS, the Village has not substantially updated its Employment Regulations since Ordinance 2001-01 was adopted January 2, 2001, with the exception of annual adjustments pursuant to Village Codified Ordinance Section 252.05 which requires the Village Manager to recommend amounts of annual adjustment based on comparisons with other public employers in Greene County, changes in the Consumer Price Index and the Village’s current economic condition; and
WHEREAS, the Village Manager has separately proposed changes to the personnel policy manual pursuant to Section 82 of the Charter due to audit and compliance concerns, but is also obligated to, “from time to time recommend to the Council for approval employment regulations including a schedule of positions together with job descriptions, rates of pay, probationary periods and conditions of promotion,” pursuant to Section 81 of the Charter; and
WHEREAS, an update to the employment regulations is necessary to the extent the Personnel Policy Manual as approved by Ordinance 2014-17 and the most recent proposed revisions in proposed Ordinance 2021-34 do not include position descriptions, rates of pay, and conditions of promotion, and based on available Village Records, no other comprehensive “Employment Regulations” have been incorporated into the Personnel Policy Manual or Chapter 252 of the Codified Ordinances since Charter Section 81 was amended by Village electors in 1990, and
WHEREAS, the Employment Regulations should reflect an accurate, updated salary scale, rather than the 2001 version, with annual amendments reflected regularly,
NOW, THEREFORE, COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO DOES HEREBY ORDAIN THAT:
Section 1. Council does hereby approve and adopt the Employment Regulations as set forth in Exhibit A*, hereby incorporated by reference in its entirety.
Section 2. The Employment Regulations shall serve as an Appendix to the Personnel Policy Manual, in effect on the date of passage; any future amendment to the Personnel Policy Manual shall include the Employment Regulations as an appendix or incorporated section subject to Sections 81 and 82 of the Charter.
Section 3. Pursuant to Section 25 of the Charter, this ordinance shall take effect immediately as an emergency upon the vote of four or more Members of Council to preserve the public interest and to provide for operation of usual Village services in that it addresses the welfare of Village employees due to the need for payroll adjustments effective with the first pay period of January, 2022.
