An Emergency Ordinance To Amend The Effective Date Of The Zoning Code Previously Adopted

Interested persons will take note that the Village Council of Yellow Springs on Monday, Oct. 21, 2013, gave rst reading to an ordinance and passed as an emergency, text to follow.
WHEREAS, the Village Charter and Chapter 713 of the Ohio Revised Code empower the Village to enact a zoning code and to provide for its administration, enforcement and amendment; and
WHEREAS, the Planning Commission recommended the repeal of the existing zoning code as codified in Part 12, Title 4 of the Codified Ordinances of Yellow Springs Chapters 1240-1284 and Appendices (the “Old Zoning Code”), and the adoption of new zoning code for the purpose of promoting the public health, safety, convenience, comfort, prosperity, and general welfare; and has held public hearings on the subject matter; and has submitted a new Part 12, Title 4 of the Codified Ordinances of Yellow Springs Chapters 1240-1284 (the “2013 Zoning Code”) to the Village Council with the recommendation to adopt the new zoning code following public hearings as reflected by the adoption of Ordinance 2013-19; and
WHEREAS, all requirements for recommending the repeal of the existing Old Zoning Code and adoption of the new 2013 Zoning Code by the Planning Commission as amended by Village Council have been met, and all requirements for Village Council’s action thereon have been likewise met; and
WHEREAS, the original effective date of December 1, 2013 for the 2013 Zoning Code was set by the original legislation and the Council desires to move the effective date forward to October 22, 2013 for the purpose of avoiding confusion and maintaining consistency as the Village transitions from the Old Zoning Code to the 2013 Zoning Code.
NOW, THEREFORE, THE COUNCIL FOR THE VILLAGE OF YELLOW SPRINGS, OHIO, GREENE COUNTY, HEREBY ORDAINS THAT:
Section 1. Village Council previously repealed the existing Old Zoning Code in Ordinance 2013-19 and adopted the new 2013 Zoning Code effective December 1, 2013.
Section 2. The effective date of the 2013 Zoning Code is hereby moved forward to October 22, 2013.
Section 3. This ordinance is hereby declared to be an emergency measure immediately necessary to preserve the public interest and for the health, safety and welfare of the citizens of the Village, and more specifically to allow for a more orderly transition from the Old Zoning Code to the 2013 Zoning Code and to conduct the public’s business without further delay, wherefore, this ordinance shall be in effect upon its adoption by Council.
