REPEALING SECTION 242.01 “COMPOSITION; CLASSIFICATION” OF THE CODIFIED ORDINANCES OF THE VILLAGE OF YELLOW SPRINGS, OHIO AND ENACTING NEW SECTION 242.01 “COMPOSITION; CLASSIFICATION”

ORDINANCE 2020-15, VILLAGE OF YELLOW SPRINGS, OHIO

Interested persons will take note that the Village Council of Yellow Springs on Monday, August 17, 2020, gave first reading to an ordinance, text to follow.Council will give a second reading for passage into law during a public hearing on Tuesday, September 8, 2020, via virtual meeting accessible at: https://zoom.us/j/3555457065.

WHEREAS, Codified Ordinance Section 242.01 of the Village of Yellow Springs, Ohio describes the composition and classification of the Police Department; and

WHEREAS, Village Council has determined that it would be in the best interest of the Village to adopt a new Section 242.01 entitled “Composition; Classification” of the Codified Ordinances of the Village of Yellow Springs, Ohio to include in the composition of the Police Department the position of Community Outreach Specialist as a full-time position; and

WHEREAS, the position of Community Outreach Specialist enhances knowledge of and access to available social services for those in need of those resources with the broader purpose of protecting and benefiting the Village; and

WHEREAS, the position of Community Outreach Specialist began as a pilot project with the intention that the Chief of Police would recommend changes to the job description with approval of the Village Manager and input from Village Council, and all parties have now agreed that the position should be made full time and that it be non-classified,

NOW, THEREFORE, THE COUNCIL OF THE VILLAGE OF YELLOW SPRINGS, OHIO HEREBY ORDAINS THAT:

Section 1. Section 242.01 entitled “Composition; Classification” of the Codified Ordinances of the Village of Yellow Springs, Ohio be repealed.

Section 2. A new Section 242.01 entitled “Composition; Classification” of the Codified Ordinances of the Village of Yellow Springs, Ohio be enacted to read as follows with new language underlined and bolded and deleted language in strikethrough:

242.01 COMPOSITION; CLASSIFICATION.

The Police Department shall be composed of a Chief of Police, as well as command staff, which may include captains, sergeants, and corporals assigned as determined by the Chief of Police and approved by the Village Manager. The Police Department shall also be composed of patrol officers and dispatcher/clerks assigned as determined by the Chief of Police and approved by the Village Manager. Part-time officers, reserve officers, and part-time dispatcher/clerks, and an outreach specialist are permitted if requested by the Chief of Police and approved by the Village Manager.

The position of Chief of Police and the position of Community Outreach Specialist shall be a non-classified, contract positions, whereas all other positions within the Department shall be classified as identified in Chapter 252.

Section 3. This Ordinance shall be in full force and effect at the earliest time allowed by law.
